To everyone in Shelburne Falls / Buckland who spent five years calling me the “harasser” and the “danger to women”:Tonight the married couple you all protected showed exactly who they are.At approximately 8:50 PM directly in front of Floodwater Brewing, with more than ten of you watching and doing nothing:
- Brook Batteau (male, Katherine Hennessey’s husband) charged out of the brewery screaming threats, got in my face, then shoved me hard. I stumbled; my phone and one shoe flew off and I hit the ground.
- While I was on the ground cowering and yelling for help, Brook punched me repeatedly.
- A male bystander grabbed both my elbows from behind, pinning my arms (he later claimed he was “trying to de-escalate,” but it left me completely defenseless).
- Katherine Hennessey immediately moved in, shoved me again, punched me in the head and body numerous times, kicked me repeatedly in the ribs and legs, seized my iPhone 16 Pro Max (>$1,200) and deliberately threw it into the Deerfield River, then followed me back toward the brewery door still kicking and punching me from behind while screaming “You deserve it.”
- Assault & Battery (M.G.L. c.265 §13A) – up to 2½ years each
- Assault & Battery with Dangerous Weapon (shod foot) (M.G.L. c.265 §15A) – up to 5 years each
- Malicious Destruction of Property over $1,200 (M.G.L. c.266 §127) – up to 10 years each
- Witness/Evidence Intimidation (destroying phone containing years of documentation) – up to 10 years each
- Assault & Battery for Purpose of Intimidation / possible Civil Rights Violation with Injury – additional felony time

they try to frame it that they are afraid of me. the facts show the opposite.

(In Support of Emergency Ex-Parte and Permanent Harassment Prevention Orders under G.L. c. 258E
and Application for Criminal Complaints)I, John Sendelbach, of Buckland/Shelburne Falls, Massachusetts, being duly sworn, depose and say under the pains and penalties of perjury:
- I am over the age of eighteen and suffer from no legal disability.
- On November 30, 2025, at approximately 7:00 p.m., directly in front of Floodwater Brewing, 40 State Street, Shelburne Falls, in the presence of more than a dozen adult witnesses, I was the victim of a prolonged, joint, racially-motivated felony assault committed by Katherine Hennessey and Brook Batteau, both of 19 School Street, Shelburne Falls, Massachusetts.
- The assault occurred as follows: • Brook Batteau charged out of the brewery screaming threats, got in my face, and shoved me hard with both hands, causing me to fall violently to the ground (my phone and one shoe flew off). • While I was on the ground covering my head and yelling for help, Brook Batteau punched me repeatedly. • An unknown male bystander pinned both my arms from behind, leaving me defenseless. • Katherine Hennessey immediately joined the attack: she punched me multiple times in the head and torso, seized my iPhone, deliberately threw it into the Deerfield River to destroy evidence of the assault, and continued kicking me with shod feet while screaming “You deserve it.”
- Earlier the same day (November 30, 2025), Katherine Hennessey trespassed on my new rental property in Buckland and made obscene gestures at me; this incident was captured on Neighbors Gas Station surveillance cameras.
- The November 30, 2025 felony assault is the direct and foreseeable culmination of more than five years of willful, malicious, and hate-driven harassment directed at me because I am a white male. The statutory minimum of three acts (G.L. c. 258E) is far exceeded; representative acts include but are not limited to:a. June 2020 – coordinated public harassment, illegal filming, physical intimidation, and racial slurs including Brook Batteau screaming “Quit your white whining” and Katherine Hennessey declaring on video “Yeah I hate you, I really do… I can hate you all I want” (video preserved). b. At least seven knowingly false police reports (2020–2023) and a baseless 258E petition in 2023, all rejected by the courts. c. September 6–9, 2024 – Katherine Hennessey sent defamatory emails to my then-landlord (The Mill at Shelburne Falls) falsely accusing me of racism, sexism, transphobia, anti-LGBTQ rhetoric, stalking, and being a “menace to the community,” expressly demanding my eviction. These emails directly caused my constructive eviction in early 2025 (copies attached as Exhibit A). d. December 6, 2022 – public tweet by their daughter and co-conspirator Alouette Batteau: “i’m around far too many white people” (https://x.com/AlouetteBatteau/status/1600012425893322755 – screenshot attached as Exhibit B). e. November 30, 2025 – trespass and obscene gestures at my new Buckland rental (surveillance preserved). f. November 30, 2025 – joint felony assault, malicious destruction of property, and intentional spoliation of evidence as described above.
- In March 2025, two Greenfield District Court judges declined to issue or extend 258E orders against Hennessey and Batteau, characterizing earlier conduct as protected speech. Hennessey and Batteau immediately interpreted those rulings as permission to escalate, culminating in the physical violence and evidence destruction on November 30, 2025.
- As a direct result of the defendants’ actions I have suffered and continue to suffer severe and ongoing fear for my physical safety, loss of my residence, and permanent destruction of years of documentary evidence stored on the phone Hennessey threw into the river.
- Absent immediate court intervention, I verily believe Hennessey and Batteau (and their daughter) will continue and escalate their violence now that they have crossed into physical assault with impunity.
WHEREFORE, I respectfully request that this Honorable Court:(1) Immediately issue ex-parte Harassment Prevention Orders under G.L. c. 258E against Katherine Hennessey and Brook Batteau ordering them to:
(a) refrain from abusing or contacting me,
(b) stay at least 300 yards away from me, my residence, and my workplace,
(c) stay away from Floodwater Brewing and The Mill at Shelburne Falls, and
(d) surrender all firearms and licenses;(2) Schedule an emergency extension hearing at the earliest possible date and, after hearing, make the orders permanent and issue criminal complaints for:
• Assault & Battery (G.L. c. 265, § 13A)
• Assault & Battery by Means of a Dangerous Weapon (shod foot) (G.L. c. 265, § 15A)
• Malicious Destruction of Property over $1,200 (G.L. c. 266, § 127)
• Witness Intimidation (G.L. c. 268, § 13B)
• Civil Rights Violation with Injury, enhanced because motivated by racial animus (G.L. c. 265, §§ 37 & 39)(3) Order restitution for my destroyed iPhone, medical expenses, and other losses; and(4) Grant such further relief as the Court deems just and proper.I declare under the pains and penalties of perjury under the laws of the Commonwealth of Massachusetts that the foregoing is true and correct to the best of my knowledge and belief.Executed this 30th day of November, 2025
